Under the Statutory Education Licence teaching staff can copy (in both hard copy and electronically) and communicate reasonable portions of any literary, dramatic, artistic or musical work for educational purposes if over 10 pages in length.

In the case of a piece of artwork or incidental artwork the entirety can be copied or communicated for educational purposes.

A piece of artwork is described as incidental if it is included to explain or illustrate a point. For example a table, photography or image in a chapter of a book or journal article.

Incidental Artworks

This includes any artwork that explains or illustrates a point within a greater work

  • Whole work.
Must be part of a larger work and be supporting or illustrate a point.
Artworks within a Hardcopy book
  • Whole work only if it hasn't been separately published or isn't available to be purchased at an ordinary commercial price in a reasonable time.

 

Artworks in electronic format
  • Whole work, regardless of availability.
